On Tuesday, Feb. 28, the Board of County Commissioners approved a settlement with several pharmacy chains related to their distribution of opioid drugs. The State of New Mexico and several of the local governments, including Doña Ana County, filed a lawsuit against numerous entities for their roles in creating the opioid crisis in New Mexico.
Last fall, the State of New Mexico went to trial against several retail pharmacies in its lawsuit. After evidence was presented, but prior to the court issuing its verdict, the State entered into a settlement with the pharmacies. The terms of the settlement, if approved by Doña Ana County and other local government entities that had filed suit, would also settle their cases against these entities. The Board of County Commissioners approved the settlement which will settle its cases against Albertsons, CVS Pharmacy, Kroger (Smith's Food and Drug) and Walmart.
As a result of this settlement, Doña Ana County will receive $3.4 million to be used to address harms caused to the residents of Doña Ana County because of the opioid crisis in the county. The County also previously entered into a settlement with several other large distributors of opioids. The case continues with other defendants to include several manufacturers, distributors and other pharmacies that were not included in this particular settlement.
